These Website and Platform Terms of Use (Terms) govern your access to and use of the Co Connect App website at www.coconnectapp.com, the Co Connect mobile application, web portal and associated documentation, features and support services (together, the Services).
If you use the Services on behalf of an employer, site operator, contractor or other organisation (Customer), you confirm that you are authorised to accept these Terms for that Customer where applicable. If a written agreement between Co Connect and a Customer covers the Services, that agreement prevails to the extent of any inconsistency. These Terms apply to individual users in addition to the Customer's agreement.
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Co Connect provides software that may help Customers communicate with their workforce and communities, share site information, administer forms and content, coordinate emergency-response teams and support approved journey-management workflows. The features available to you depend on the Customer's subscription, configuration and permissions.
The Services are a communication and workflow tool. They do not replace a Customer's safety-management system, emergency-response plan, site rules, supervision, training, professional judgement or legal obligations. They are not an emergency service or a guarantee that a message, alert, location signal, form or escalation will be received, acted upon or delivered within any particular time.
In an emergency, follow the Customer's current emergency procedures and contact the relevant emergency service or site emergency contact. In Australia, call 000 where appropriate. Do not rely solely on the Services.
You must provide accurate account information, keep it current and protect your login credentials. Do not share your account or allow another person to use it. You are responsible for activity through your account unless it results from Co Connect's failure to use reasonable security measures.
Customers control access to their users' accounts and may create, change, suspend or remove access. Co Connect may require identity verification or take reasonable steps to protect the Services, Customer Data or other users.
Tell us promptly at support@coconnectapp.com if you suspect unauthorised access to your account.
You must use the Services lawfully, responsibly and in accordance with the Customer's policies and instructions. You must not:
We may remove content, restrict access or suspend an account where reasonably necessary to protect people, comply with law, investigate a suspected breach, or protect the Services. Where practical, we will give notice.
Customers and authorised users may enter, upload or generate content through the Services, including forms, reports, images, documents, comments, contact details, location information and alerts (Customer Content). The Customer retains ownership of Customer Content. You retain ownership of material you create to the extent you own it, subject to the Customer's rights and policies.
You grant Co Connect a limited, non-exclusive right to host, copy, transmit, display and otherwise process Customer Content only as needed to provide, secure, support and improve the Services, comply with law and meet our obligations to the Customer. We may use de-identified and aggregated information to operate, analyse and improve the Services, provided it does not identify you or the Customer's individuals.
You are responsible for ensuring that Customer Content is accurate, lawful and authorised. Co Connect does not independently verify Customer Content and is not responsible for Customer decisions made using it.
The Services may send push notifications, SMS, email, WhatsApp messages, voice calls or other communications when enabled by a Customer or chosen by you. Delivery depends on device settings, telecommunications networks, third-party services, internet access and other factors outside Co Connect's control. Keep your contact details and device settings current if you want to receive notifications.
Location, journey-management, duress or check-in features operate only when enabled, configured and used as intended. Location accuracy and availability can be affected by device hardware, permissions, satellite coverage, network coverage, environment, battery level and other conditions. These features are an aid to a Customer's procedures, not a substitute for them.
Co Connect and its licensors own the Services, software, templates, documentation, branding and all related intellectual-property rights. Subject to these Terms and any Customer agreement, Co Connect grants you a limited, personal, non-transferable, revocable right to access and use the Services for their intended purpose. All rights not expressly granted are reserved.
You may provide feedback. We may use it without restriction or compensation, provided we do not identify you without permission.
The Services may interact with third-party platforms, networks and app stores. Their terms and privacy policies apply to their services. Co Connect is not responsible for third-party services, their content, availability or practices.
We aim to provide reliable Services but do not promise uninterrupted or error-free access. We may maintain, modify, suspend or discontinue features where reasonably necessary. We will take reasonable steps to minimise material disruption to paid Customers in accordance with their agreement.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including consumer guarantees under the Australian Consumer Law.
To the maximum extent permitted by law, the Services are provided “as is” and “as available”. Co Connect does not warrant that the Services will be uninterrupted, error-free, suitable for a particular purpose, or that any communication, alert, report, location signal or escalation will be received or acted on.
To the maximum extent permitted by law, Co Connect is not liable for indirect, special, incidental, punitive or consequential loss, loss of profits, revenue, goodwill, data or opportunity, or loss arising from a Customer's policies, decisions, content, configuration, connectivity, third-party services or a user's failure to follow emergency procedures.
Where liability cannot be excluded and is not otherwise limited by a written Customer agreement, Co Connect's aggregate liability to an individual user for a claim arising from these Terms is limited to re-supplying the affected Services or paying the cost of having them re-supplied, at Co Connect's option, except where law requires otherwise.
You may stop using the Services at any time. A Customer's agreement determines Customer access and data handling on termination. Co Connect may suspend or terminate your access if you materially breach these Terms, create a security or safety risk, or we are required to do so by law. Sections that by their nature should survive termination will survive.
We may update these Terms from time to time. The current version will be published on our website with its effective date. For a material change, we will take reasonable steps to notify affected Customers or users before it takes effect. Continued use after the effective date means you accept the updated Terms.
These Terms are governed by the laws of Western Australia and the parties submit to the exclusive jurisdiction of its courts and courts entitled to hear appeals from them. Before commencing proceedings, the parties should try in good faith to resolve a dispute through senior representatives, except where urgent relief is required.
